 Winchester Tractor Trailer Accident — $2.5M

Patrick’s case was a complex one. He suffered an exacerbation of his pre-existing Chiari Malformation symptoms when his work vehicle was hit by a large truck.

At the time of the crash, Patrick was on the job in his delivery truck. While attempting to make deliveries, the engine of his delivery truck stopped running and he lost all power. Patrick’s truck quickly decelerated and he was forced to steer to the gravel shoulder of the roadway. The truck came to a stop at the entrance of a public business. Patrick turned on his flashers and waited for a new truck to arrive from his employer’s location. While waiting, a large flat-bed truck came out of the entrance to the business and struck the rear driver side corner of the truck Patrick had been driving.

Prior to the accident, Patrick had an undiagnosed asymptomatic congenital condition known as Arnold Chiari Malformation, as well as protrusion of the upper end of the spine into the skull and tethered cord syndrome. Each of these conditions were worsened by the accident and made symptomatic. In addition to these conditions, Patrick also suffered herniated discs at L4-5 and L5-S1 and developed lumbar disc disease at these levels. Patrick underwent four very painful surgeries.

The difficulty with Patrick’s case was his asymptomatic, pre-existing conditions. The workers’ compensation carrier was denying coverage for several medical treatments related to Patrick’s pre-existing injuries. It appeared that Patrick was going to be stuck with paying for medical treatment out of his pocket with no compensation for time off work.

Winchester Car Accident — $1.35M

Bruce was the front seat passenger in a minivan stuck head on by a Ford 250 pickup truck pulling a competition farm tractor. The F250, traveling at an extremely high rate of speed, had crossed a double solid yellow line and attempted to pass another vehicle. The minivan in which Bruce was riding was turning right onto the roadway where defendant was illegally passing. As the minivan turned right into its lane of travel, the defendant’s truck was immediately bearing down on the minivan. Because the F250 was passing illegally and traveling at an excessively high rate of speed, there was not time for sufficient evasive action by either the minivan or the F250.  The two vehicles collided head on.

After the collision, Bruce was conscious at the scene but became agitated and suffered from a rapidly declining mental state in the emergency transport. Bruce was initially taken to Warren Memorial Hospital Emergency Room, but due to the severity of his injuries, was then flown to Washington Hospital Center in Washington, D.C.

Upon arrival at Washington Hospital Center, Bruce was determined to have suffered fractures of his right public bone, tibia/fibula fracture, clavicle fractures, skull fracture, and maxillary bone fracture.

The defendant’s insurance company fought paying this claim. The insurance company and defendant even filed a counter-claim against the driver of the minivan. The insurance company attempted to hide other coverages that were available on the F250.

Winchester Workers’ Comp Settlement — $1.224M

George was an employee of a local equipment company servicing a client on a particularly cold, icy day.  In carrying out his job, George slipped and fell on ice.  As a result of his fall, George suffered a T2-T3 fracture, resulting in thoracic spinal cord paraplegia.
